This Privacy Policy explains how MyHealerDoc (“the App”, “we”, “our”) collects, uses, stores, and protects your personal data when you use our mobile application available on the Apple App Store and Google Play Store. By using the App, you consent to the practices described in this Policy.

2. Terms of Use
2.1 Acceptance of Terms
By downloading or using MyHealerDoc, you acknowledge and agree to be bound by these Terms of Use. These Terms apply to all users, including patients, care specialists, and service providers.
2.2 Nature of the Platform
MyHealerDoc is a digital healthcare service platform operated by Mitra Healthcare Sdn. Bhd., connecting patients with qualified care specialists. The platform itself does not provide medical treatment but facilitates communication between users.
2.3 Limitation of Liability

MyHealerDoc and Mitra Healthcare Sdn. Bhd. are solely a digital platform that facilitates communication between patients and independent care specialists. We do not provide medical care, diagnostics, or treatment.

MyHealerDoc and Mitra Healthcare Sdn. Bhd. are immune from legal claims, lawsuits, or damages arising from any interaction, consultation, treatment, advice, or service provided by care specialists.

Users agree that neither MyHealerDoc nor Mitra Healthcare Sdn. Bhd. can be brought to court or held liable for medical outcomes, professional conduct, service quality, or negligence committed by care specialists.

Patients acknowledge that all healthcare services are delivered directly and independently by licensed care specialists who remain fully responsible for compliance with Malaysian healthcare laws.
2.4 Compliance with Malaysian Healthcare Regulations Compliance with Malaysian Healthcare Regulations
All care specialists using the App must comply with the laws and regulations governing the Malaysian healthcare sector. Non‑compliance may result in suspension, termination, reporting to authorities, or legal action.
2.5 Anti‑Poaching Policy
Care specialists agree to the following:

No poaching of customers directly or indirectly from the MyHealerDoc platform.

All patient interactions must remain strictly within the App unless otherwise authorized in writing by Mitra Healthcare Sdn. Bhd.

If a care specialist is found poaching or attempting to poach customers, a penalty fine of USD 100,000.00 will be imposed.

MyHealerDoc, under its legal trademark owner Mitra Healthcare Sdn. Bhd., reserves full legal rights to enforce and recover this penalty, including through legal action.
2.6 User Obligations
Users agree to:

Provide accurate and truthful information.

Use the App only for lawful purposes.

Not engage in abusive, fraudulent, or harmful behaviour.
2.7 Suspension & Termination
Mitra Healthcare Sdn. Bhd. may suspend or terminate any user account for violations of these Terms, unlawful conduct, or risks to patient safety.
2.8 Intellectual Property
All trademarks, logos, branding, design, and content of MyHealerDoc are the intellectual property of Mitra Healthcare Sdn. Bhd. No part may be used, reproduced, or redistributed without written consent.
2.9 Governing Law
These Terms are governed by the laws and regulations of Malaysia, including but not limited to:

The Private Healthcare Facilities and Services Act 1998 (PHFSA)

The Medical Act 1971 and Medical Regulations 2017

The Healthcare Facilities Licensing requirements

The Personal Data Protection Act 2010 (PDPA)

Any directives issued by the Ministry of Health Malaysia (MOH)
All users and care specialists agree to comply with the full scope of Malaysian healthcare laws. Any violation may result in reporting to relevant authorities, legal action, suspension, or permanent removal from the platform.
